Your AI Wrote the Backend. You Own the Breach.
The pitch is seductive: ship faster, code less, build without years of experience. AI tools promise to democratise software development. Anyone can build an app now.
What they're not telling you is that you're legally responsible for the security of what you ship, even if the AI wrote every line.
Prompt Injection Isn't a Bug, It's Physics
Here's the structural problem: if the model can't distinguish instruction from context, then every "guardrail" is just a textual suggestion sitting in the same channel as the attack.
That means every AI-generated app inherits the same porous privilege model. The same inability to enforce boundaries. The same susceptibility to social engineering at the protocol level.
When a developer says "my AI wrote the backend," what they actually mean is: I deployed a system whose security model is vibes.
The Governance Perimeter Just Collapsed
Most developers shipping AI-generated code are thinking about features, UI, monetisation, MVP velocity.
They are not thinking about privilege separation, capability boundaries, input sanitisation, lineage tracking, revocation, auditability, or substrate-layer invariants.
They're shipping apps with:
- AI-generated authentication logic
- AI-generated database queries
- AI-generated API integrations
- AI-generated error handling
None of which have been threat-modelled. None of which have been audited. None of which were written by someone who understands the attack surface.
This isn't "move fast and break things." This is move fast and accidentally expose user data to the entire internet.
The AI Liability Trap Nobody Warns You About
Here's where it gets legally uncomfortable.
California's AB 316, effective January 2026, explicitly prohibits an "autonomous harm defense." You cannot shift blame to the technology's independent decision-making when AI involvement allegedly caused damage.[1]
A February 2026 federal court ruling found that using consumer-grade generative AI tools can destroy attorney-client privilege and work product protection.[2]
The pattern is clear: developers and deployers of AI systems bear legal liability for harms their AI-generated code causes, regardless of who wrote it.
Courts don't care that:
- Claude wrote it
- GPT scaffolded it
- You didn't know it was insecure
- You're just an indie dev
If your app leaks PII, financial data, health data, or authentication tokens, you're on the hook.
Breach notifications. Regulatory fines. Civil liability. Class-action exposure. Forensic audits. Compliance obligations.
Indie developers scaling from free tier to paid service are not prepared for this. They think they're building a SaaS. They're actually building a liability surface.
Real-World Consequences Are Already Here
A client recently handed me 7,000 lines of AI-agent-generated code they had installed directly onto their production stack.
It overwrote their existing configuration. No governance check. No review layer. No boundary hygiene. Just raw output deployed as if volume equals value.
Those 7,000 lines could have been reduced to 300.
This isn't hypothetical. It's happening right now, at scale.
The Industry Is Pretending the Substrate Is Safe
The messaging is all velocity: ship faster, build with no experience, prototype in hours.
But nobody is saying:
- AI-generated code is not vetted
- Prompt injection is not solved
- Your app inherits the model's vulnerabilities
- You are responsible for the consequences
- US AI regulation 2025 makes you liable
- AI regulations around the world 2025 are tightening
The industry is accelerating adoption without accelerating accountability because acknowledging the opposite would slow adoption.
But the substrate is not safe. The perimeter is not governed. The developer responsibility for AI code breach is real, not theoretical.
Who Owns the Breach?
If you're shipping AI-generated code to clients, or accepting it from a developer, ask yourself: have you signed terms defining who's liable when it fails?
No warranty disclaimer. No limitation of damages. No indemnification clause. No definition of AI code ownership liability before the breach happens.
Enterprise vendors negotiate these terms before a single line of code ships. Indie developers hand over repositories with a Slack message and a thumbs-up emoji.

If there are no terms, the answer to "who is responsible for AI mistakes" is simple: whoever delivered the code, whether they knew it was insecure or not.
The Question Nobody Wants to Answer
What happens when millions of non-experts deploy AI-generated systems with no governance perimeter, no threat model, and no understanding of the liabilities they're creating?
We're about to find out.
And "my AI wrote it" is not a defence.
